Ooka Radio+ Subscription Cancellation and Refund Policy
When you subscribe to Ooka Radio Service provided by the Company in a particular geographical territory specified by the Company, your contract with the Company is completed upon receiving a confirmation email from the Company; and performance of Ooka Radio Service begin as soon as the subscription is completed.
If you are a subscriber of any of the paid Ooka Radio+ plans provided under the Ooka Radio Service, and have paid the subscription fee thereto, and your subscription is not activated or you are unable to access the subscription plan, you shall communicate the issue to the Company immediately. In the event the Company is unable to rectify above complaint in your subscribed Ooka Radio Services within 7 (seven) days of your complaint, you will be eligible for refund of subscription fee as per the following terms:-
Company will initiate pro rata refund of the subscription fees paid by you for availing Subscription to access the Ooka Radio Service, excluding any applicable bank transaction charges. Refund will be processed within 15 (fifteen) business days, based on the Payment Method used at the time of paying the subscription fee or will be credited in your debit/credit card or online account. If payment is done via store billing through cheque, specific application store refund policies will apply. After the cancellation of subscription by the Company , you won’t be able to access the subscribed Ooka Radio Service or any content downloaded from the Site, the Mobile Site or the Ooka Radio Application.
Subsequent to the cancellation by the Company , if you wish to re-subscribe to any of the plans provided under the Ooka Radio Service, a fresh subscription fee will be charged thereto.
How to unsubscribe and request a refund

Refund in case of defective content
Any content once made available to you under the Ooka Radio Service by way of your Subscription, should be checked by you to ensure its streaming and performance. In the event of any error or defect in its performance, or streaming you should get in touch with the customer service team of the Company or email@example.com
After receiving the complaint from you, the Company will check the authenticity and nature of your complaint. Once the Company is satisfied that the complaint is genuine; it will take necessary reasonable steps to fix the defect in your subscribed Ooka Radio Services.
In the event the Company is unable to rectify the defect in your subscribed Ooka Radio Services within 15 (fifteen) days of activation of your Subscription, you may choose to opt for a refund in such case and the Company will proceed with the refund of your subscription fees as per clause 1.3 above.
Refund Policy in case of Free Trial
Upon your Subscription of Ooka Radio Service, you won’t be billed for the free trial period, if applicable to you. If your Subscription is not cancelled before the end of the free trial period, your paid Subscription will automatically start at the end of free trial period. It is clarified that in certain Ooka Radio+ packs, which is intimated to the user at time of purchase, automatic renewal happens and payment will be applicable.
During the free trial period of your Subscription of Ooka Radio Service you won’t be eligible for any refund in case any defective content is provided to you. However you should inform the customer service team of the Company about the defective content, so that the Company takes effective measures to ensure that the defect doesn’t continue after the end of free trial period. If the defect in the content of your Ooka Radio Service continues after the start of the paid Subscription period, then the Company will allow refund as per the terms and condition stated in Clause 3 hereinabove.
By availing the Subscription, it shall be construed that the User(s) has waived his/her right to raise any dispute with regard to the Subscription cancellation and/ or refund in any manner whatsoever to the extent permissible under law.
All and any incidental costs direct and/or indirect, in relation to availing, cancelling and/ or refund of the Subscription under this refund policy, shall be borne by the User(s) and in no manner whatsoever shall the Company, be responsible or liable for the same.
Company shall not be responsible and/or liable in any manner whatsoever for any network problem, breakdown of machinery, unclear network, disruption in the network and/ or payment gateway errors. Any dispute in connection to the above shall be settled between the User(s) and the telecom/mobile operator/ the concerned bank/ credit card/ payment gateway directly, without involving Company.
Company shall not be liable and /or responsible in any manner whatsoever in the event of any malfunction/fault/ failure in the mechanism/ system failure/ due to technical/ technological restrictions and /or due to reasons /events/incidents beyond the commercially reasonable control of Company and the User(s) shall hold harmless Company and its employees, officers or any other person in relation to the refund of the subscription fee with respect to the same.
Limitation of Liability
IN NO CASE SHALL COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, PRINCIPALS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USER(S) USE OF THE OOKA RADIO SERVICE OR THE SUBSCRIPTION OR MATERIAL THEREOF OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO USE OF THE OOKA RADIO SERVICE OR THE SUBSCRIPTION OR MATERIAL THEREOF, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN THE SUBSCRIPTION, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE OOKA RADIO SERVICE OR THE SUBSCRIPTION OR MATERIAL THEREOF, EVEN IF ADVISED OF THEIR POSSIBILITY.
